1. Agreement to Terms

By accessing or using Sumciq AI CRM platform, websites, or any related services provided by Sumciq, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not access the platform or use our services. These terms constitute a legally binding agreement between you and Sumciq regarding your use of the AI-powered customer relationship management system.

Sumciq is registered in Nuremberg, Germany, and operates globally, providing intelligent CRM solutions for businesses of all sizes. Throughout these terms, "Sumciq", "we", "us", or "our" refers to Sumciq, and "you" or "your" refers to any user, customer, or entity accessing our services.

2. Account Registration and Security

To access certain features of Sumciq AI CRM, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to maintain its accuracy. You are solely responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account or any other breach of security. Sumciq shall not be liable for any loss or damage arising from your failure to comply with these security obligations. We reserve the right to suspend or terminate accounts that are found to be compromised or used for fraudulent activities.

3. Use of AI CRM Platform

Sumciq grants you a non-exclusive, non-transferable, revocable license to access and use our AI CRM platform for your internal business purposes, subject to these Terms and Conditions. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the service without express written permission from Sumciq.

Our AI features, including predictive analytics, automated recommendations, and intelligent lead scoring, are provided as tools to support your business decisions. While we strive for accuracy, you acknowledge that AI-generated insights are suggestions only, and final business decisions remain your sole responsibility. Sumciq does not guarantee specific outcomes or results from using our AI capabilities.

  • You may not use the platform for any illegal or unauthorized purpose
  • You may not interfere with or disrupt the integrity of the platform or its data
  • You may not attempt to reverse engineer or extract the source code of our AI models
  • You may not use the platform to store or process sensitive personal data without proper authorization

4. Data Privacy and Processing

Your use of Sumciq AI CRM involves the processing of customer data, business information, and potentially personal data. We act as a data processor for the information you upload to our platform, while you remain the data controller responsible for ensuring compliance with applicable data protection laws, including the General Data Protection Regulation (GDPR).

We implement appropriate technical and organizational measures to protect your data, including encryption, access controls, and regular security audits. However, you are responsible for obtaining necessary consents from your customers before processing their personal information through our platform. For detailed information about how we handle data, please refer to our Privacy Policy.

5. Intellectual Property Rights

All content, features, and functionality of Sumciq AI CRM, including but not limited to software, algorithms, AI models, user interfaces, text, graphics, logos, and trademarks, are owned by Sumciq or our licensors and are protected by German, European, and international copyright, trademark, patent, and trade secret laws.

You retain ownership of all data, content, and information you input into the platform. By submitting data to Sumciq, you grant us a limited license to process, store, and analyze such data solely for the purpose of providing and improving our services to you. We do not claim ownership of your business data or customer information.

6. Prohibited Activities

You agree not to engage in any of the following prohibited activities while using Sumciq AI CRM:

  • Uploading malicious code, viruses, or harmful software to the platform
  • Attempting to gain unauthorized access to other user accounts or data
  • Using the platform to send spam, unsolicited messages, or deceptive communications
  • Scraping or harvesting data from the platform for competitive purposes
  • Using our AI capabilities to generate misleading, fraudulent, or harmful content
  • Interfering with the proper functioning of our AI models or infrastructure

Violation of these prohibitions may result in immediate termination of your account and potential legal action. We reserve the right to investigate any suspected violations and cooperate with law enforcement authorities.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Sumciq and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the platform.

Our total liability to you for any claims arising from these terms or your use of the platform shall not exceed the amount you have paid to us, if any, during the twelve-month period preceding the event giving rise to the liability. Some jurisdictions do not allow certain liability limitations, so this provision may not apply to you fully.

8. Termination and Suspension

We may terminate or suspend your access to Sumciq AI CRM immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions. Upon termination, your right to use the platform will cease immediately. You may also terminate your account at any time by contacting our support team.

After termination, we may retain your data for a reasonable period as required by law or for legitimate business purposes, after which it will be deleted. We are not obligated to return any data to you upon termination unless required by applicable law.

9. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any dispute arising from or relating to these terms or your use of Sumciq AI CRM shall be subject to the exclusive jurisdiction of the courts located in Nuremberg, Germany.

Before initiating any legal proceedings, you agree to first attempt to resolve the dispute informally by contacting us at contact@sumciq.com. We will attempt to resolve any dispute within thirty (30) days of receiving your notice.

10. Changes to Terms

We reserve the right to modify or replace these Terms and Conditions at any time. If a revision is material, we will provide at least thirty (30) days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our platform after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the platform and close your account.
